Israeli Minister Supports High Court Decision Amidst Legal-Tech Constitutional Controversy

In a recent statement, Israel’s Culture and Sports Minister Miki Zohar assured that Prime Minister Benjamin Netanyahu will adhere to any decision made by the High Court of Justice. This comes amidst allegations that the government is on a path to incite a constitutional crisis. Zohar’s comments were prompted by the cabinet’s approval of a resolution, which declared it would not acknowledge decisions from the Council of the Second Authority, based on a High Court ruling. This ruling allowed the broadcasting regulator to continue its operations, despite not meeting the necessary quorum.

The government has expressed concerns that the court’s ruling contradicts existing laws, emphasizing that all state bodies, including the judiciary, should function within the legal framework. Zohar clarified that the cabinet’s resolution aims to avert a constitutional crisis rather than precipitate one. President Isaac Herzog has voiced his apprehension, stating that failing to comply with High Court rulings would represent crossing a “red line.” Meanwhile, former Prime Minister Naftali Bennett warned that ignoring judicial decisions could result in constitutional disarray and potentially destabilize the democratic system of governance in Israel.

The crux of the dispute involves the broadcasting council’s authority in approving the proposed acquisition of Channel 13. Critics have accused the government of trying to exert political influence over media regulation through its control over the broadcasting council. This has raised fears of political interference and attempts to sway media operations under governmental oversight.
